Necessities When Applying For Cancellation Of Removal

By Kevin Carter

If you find yourself in a continuing case in the immigration court in front of an immigration magistrate, you can be liable for this application. You cannot, however, apply if you do not have a case or if a previous case has been ruled closed. Cancellation of removal is a form of respite from being taken out of the country. Like all applications, there are a couple of necessities you need to fulfill to be liable for an application in the city of Miami.

You must have lived in the country for at least ten years. When showing up in court, you should take with you all the possible documents that might confirm your continuous presence in the country for the said amount of time. These papers could comprise of marriage certificate, medical records, and receipts.

You must also be of ethical character. You should be able to prove before the court that you are of impeccable morals. Letters from friends and family members confirming this would come in handy, tax records and documented proof that you contain no arrest records. Available family members could give live testimonies to back up your claims.

It would also help if you could provide evidence that your deportation would cause harm and hardships to a lawful citizen of the country that you would leave behind as a child or a spouse. For a better chance you must show that the hardship would be to an extreme level, that is, worse that would supposedly happen to someone deported to an underdeveloped third world country. You should also take with your credentials confirming your child or spouse is a permanent citizen.

Your application will be inevitably refuted if you are found to have a record of being a consistent drunkard, being involved in any form of illegal trafficking. You have been found in possession of unlawful drugs, you have been jailed for more than half a year. You have been found with offenses of ethical turpitude and have made a living through unlawful money betting.

Your request can also be denied if you are found to be a polygamist, have participated in immorality conducts, have been sentenced because of crimes of aggression, have made untrue claims that you are a legal citizen and registered to be a voter and have given incorrect information to obtain immigration welfare.

It is important to be fully prepared before appearing in court. Be ready to give a statement before the judge and give all your answers in absolute truthfulness. Request a few of your colleagues and family members to appear on the stand to assist in making sure you stay in the country. It also helps to hire a good attorney to assist with all the legal proceedings.

You should also make sure you provide all the documentation needed to affirm all your previous claims. Getting cancellation is difficult; therefore, ensure that you provide information that is truthful. Providing false information will not only lead to the judge denying your request but it may also get you convicted for a long time.
